I believe that the OCR Board is asking far too much from 16-17 year olds...

I mark sources and there is a reference to MR however it is not an essential part ofthe question - Thye can make ref to intention or 'he didnt mean to' for instance however it is not necessary to obtain the full marks. Many students nationally actually respond to the q in that - way almost similar to a common sense approach.

Thanks for that clarification. I know mens rea can be found when teaching Presumptions but how many AS students can really cite these? So it's reassurring to know that more non-legal definitions will get credit.
